Update: Judge Says 50 Cent's Lawyer Can Remain In Child Custody Case

The New York judge in 50 Cent's child custody case has allowed the rapper's lawyer to stay in the case despite 50's ex-girlfriend claiming that there was a conflict of interest.

, Shaniqua Tompkins, 50's ex-girlfriend and the mother of his son, asked the judge to remove Brett Kimmel from the case because she sought legal advice from him in 2005.

Tompkins claimed she called Kimmel to talk about child support, palimony and her financial interest in 50 Cent's movie, Get Rich or Die Tryin'.

According to The Associated Press, Judge Carol Edmead allowed Kimmel on Tuesday (July 15) to stay on the case because he never created an attorney-client relationship with Tompkins.

Edmead will determine who will have custody of the former couple's child and who will collect insurance money on the $2.4 million Long Island house that burnt down in May.

Tompkins, who lived with 50's son in the house, has publicly claimed that 50 Cent orchestrated the fire. 50 denied the allegation and shot back with a $20 million defamation suit against Tompkins, currently pending.

50 Cent and Tompkins have been fighting over the house after the rapper attempted to have her evicted from the home unless she paid rent.

The cause of the May fire has not been determined.
